1. Introduction

Upfront Studio respects the privacy of everyone who uses its website, software and apps. This privacy policy describes which data we collect, how we use it and which rights you have. It applies to this website, to our services and to all products and apps we release under the name Upfront. The data controller is Dial Direct B.V., trading as Upfront Studio.

2. Data we collect

We only collect data that is necessary to provide our services. This includes contact details (name, email address, phone number), company details and technical data required for website development and hosting.

3. Data in our apps

Alongside websites and software we release our own products and apps under the name Upfront. In our apps we process only the data needed to make the app work and to improve it. Which categories apply to a given app is set out in that app's privacy label in the App Store and in the information the app itself provides. We do not sell personal data and do not share it with third parties for their own marketing purposes. We only request access to sensitive device features (such as camera, microphone, location or contacts) where an app feature requires it, and only after you have given permission. You can withdraw permission at any time in your device settings. We do not track you across apps and websites owned by other companies, unless you expressly allow this through the App Tracking Transparency (ATT) permission prompt. We use crash reports and usage statistics solely to keep the app stable and usable, aggregated or pseudonymised where possible.

4. Cookies

Our website uses functional cookies that are necessary for the website to work. Analytical cookies may also be used to analyse and improve how the website is used. You can disable cookies in your browser settings. This may affect the functionality of the website.

5. Use of Data

The data collected is used solely for: performing the work agreed; providing and supporting our software and apps; communication about projects and services; invoicing and administration; and improving our services.

6. Retention

We do not keep your data longer than necessary for the purposes for which it was collected. After a collaboration ends, project data is kept for a maximum of 7 years for administrative purposes, after which it is deleted.

7. Deleting your account and data

If you have created an account in one of our apps or products, you can have that account and the associated data deleted. You can do this directly in the app, and always by sending a request to support@upfront.studio from the email address linked to the account. Following a deletion request we erase your account and the associated personal data from our active systems within 30 days, except for data we are legally required to retain (such as invoicing data under tax retention rules). Backups still containing the data are overwritten in line with our regular backup schedule. Step-by-step instructions are on our customer service page.

8. Deletion of Project Data

If no agreement is concluded, or when a collaboration ends, all company data, designs and other confidential information will on request be fully removed from our systems. This includes all company documents and data received, concepts, designs and prototypes, access details and login credentials, and all other confidential information. You can submit a deletion request via hello@upfront.studio. We will comply with your request within 30 days.

9. Sharing with Third Parties

We do not share your data with third parties unless this is necessary to provide our services or where we are legally required to do so. We enter into data processing agreements with the parties that process data on our behalf, such as hosting and cloud providers, payment processors and crash reporting providers. They may only use the data for our assignment. Purchases you make in an app are handled by the relevant app store. Processing of your payment details is then covered by that party's privacy policy; we do not receive full payment details.

10. Children

Our services and apps are not aimed at children under the age of 16 and we do not knowingly collect their personal data. If we discover that we have processed such data, we delete it as quickly as possible. If you are a parent or guardian and suspect this has happened, please contact us at hello@upfront.studio.

11. Security

We take appropriate technical and organisational measures to protect your data against unauthorised access, loss or misuse. This includes encrypted connections, secured servers and restricted access to data.

12. Your Rights

You have the right to request access to your personal data, request correction or deletion of your data, object to the processing of your data, transfer your data to another party, and withdraw any consent given at any time. You can also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
